WEBSITE TERMS AND CONDITIONS OF USE

Introduction

This website (“Site”) is owned and operated by Belmont 16 Foot Sailing Club (the Club). The laws of New South Wales will govern these Terms of Use. The Club provides materials on the Site, including text, images, audio and video, (“Materials”) for information purposes only. By choosing to use this Site or download Materials, you agree to the following terms and conditions (“Terms of Use”). If you do not accept the Terms of Use, you should not use the Site or download Materials. No verbal discussion or negotiations for the supply of any product or service will be binding unless confirmed in writing by the Club.

Intellectual Property

All Materials are copyright to the Club and must not be distributed, modified, reproduced or used for any commercial purpose, in whole or in part, without the Clubs prior written consent which it may refuse in its complete discretion. The Clubs logos or brand names shown or mentioned on the Site are registered trademarks of the Club. Subject to these restrictions, you may download and use Materials.

Use of The Site

You will not use the Site for any purpose that is unlawful or prohibited by the Terms of Use. You will not use this Site to collect or store personal information about other users of the Site. You will not try to gain unauthorised access to any part of the Site or to upload any virus, data, program or other item that may corrupt or affect adversely the operation of the Site. The Club will use its best efforts to ensure that the Site remains functional, but does not warrant that your access to or use of the Site will be uninterrupted or error-free. In particular, but without limitation, the Club will not be liable for any damage to your computer equipment arising from your access to the Site or your downloading of Materials; or any consequential damage that may result from your use of, or inability to use, the Materials.

Pricing

The Club states a price on the Site in relation to a product or service, that price is just indicative of the current price and should not be taken as a recommended price for that product or service. No dealer, distributor, reseller or stockist of The Clubs Products or Services has any obligation to charge a stated price for the relevant product or service. Prices in this site will include GST where applicable.

Third Party Products and Websites

A reference on the Site to any products or services offered by another person or company (“Third Party”) or to any Third Party web sites is for information purposes only and should not be taken as an endorsement or recommendation by the Club of that Third Party or its products or services. The Club makes no representations and gives no warranties as to the quality, safety or suitability for purpose of any Third Party’s products. The Club does not claim any proprietary rights to any Third Party’s logos or brand names mentioned on this Site. If you use a link from this Site to a Third Party’s website, you acknowledge that the Club has no control over the content of that website and no responsibility for any loss or damage arising from a transaction that you may enter after linking to that website.

Limitation of Liability Arising From Site Use

The Club will take reasonable steps to ensure that Materials are accurate and complete. However, as Materials are compiled from a variety of sources, the Club does not make any warranties or representations regarding their completeness or accuracy. To the maximum extent allowed by the governing law, the Club will not be liable for any consequential loss or damage arising from any mistake in or omission from the Materials. The Club will have no liability for representations made on the Site unless confirmed in writing in relation to a specific project or engagement. If you select a product or service shown in the Materials that does not meet your performance or use requirements, the Club will not be liable to you for any alleged consequential loss or damages.

Revision of Terms of Use

The Club may revise these Terms of Use at any time and suggests that you periodically check for any revisions that may affect you.

Privacy Information

We collect information only in relation to membership and communicating offers, you consent to us using the information in this way. You can ask for access to your information. We will not exchange your information with any third party. You acknowledge that we use tracking via Google analytics to track usage of the site to enable site improvements and we agree that this data will not be correlated with personal information of any kind.

The following conditions are for the sale of all online goods and services:

1. It is against the law to sell or supply alcohol to, or to obtain on behalf of, a person under the age of 18 years. When applying for or renewing membership with the Club, you warrant that you are over the age of 18 years.
2. No refund or exchange on any purchase except as required by law and as otherwise specified by the seller. If a refund is made, the Club may, to the extent permitted by law, retain any fee it has charged.
3. The right is reserved to charge a fee for the replacement of membership cards.
4. The right of admission is reserved and is subject to the venue’s terms of admission.
